This Privacy Policy describes how InScape ("we," "us," "our," "InScape") collect, use, disclose, and protect information in connection with the InScape websites, mobile website, software applications, browser extensions, in-person events (and/ or experiences), including third party platform promotions sponsored by InScape that specifically refer or link to this Privacy Policy ("Services").

Sources of Collection

InScape collects, processes, stores and uses personal information in connection with your access to and use of the Platform. Personal information may be collected directly from you, automatically through your use of the Platform, or from approved third parties where necessary to provide the Platform and related services.

We may collect personal information when you create or manage an InScape Account, purchase or renew a Membership, purchase a Campaign Access Package, participate in Campaigns, receive or allocate Campaign Credits, access or redeem Partner Offers, participate in referral programs or promotional activities, contact our customer support team, respond to surveys or promotions, or otherwise interact with the Platform.

When you access the Platform through our website, mobile application or other supported digital services, we may automatically collect technical and usage information through cookies, log files, analytics technologies and similar technologies. This information assists us in operating, maintaining, securing and improving the Platform, detecting fraudulent activity, administering Campaigns and Memberships, and enhancing the overall Member experience.

We may also receive information from third parties, including payment providers, identity verification providers, fraud prevention providers, analytics providers, affiliate partners and Direct Partners where necessary to process transactions, verify eligibility, administer Campaigns, fulfil prizes, facilitate Partner Offers, comply with applicable laws or otherwise provide the Platform and its services.

In some jurisdictions, certain types of information we collect may be considered “sensitive” personal information including:

  • Demographic information, such as your gender, age, household income, or marital status, only to the extent you provide this information to us as demographic information in a survey response that is identifiable to you, and
  • Precise geo-location data, to the extent you have configured your device to disclose such information to us.

Note that we only use this sensitive information to provide the Services to you and we do not collect, use or disclose this sensitive information for the purpose of inferring characteristics about you.

We do not “sell”, “trade” or “share” sensitive personal information or use sensitive data for “targeted advertising” as those terms are defined in including (but not limited to) U.S., Australia, Canada state privacy laws.

Use of Information We Collect

InScape collects, processes and uses personal information for legitimate business, operational, contractual and legal purposes associated with providing, maintaining, improving and protecting the Platform and the services offered through it.

The personal information we collect enables us to establish and administer Member Accounts, operate Campaigns, issue and manage Campaign Credits, administer Memberships and Campaign Access Packages, facilitate Partner Offers, fulfil prizes, comply with applicable laws and regulations, and deliver a secure, personalized and reliable Platform experience.

The purposes for which we may use your personal information include, but are not limited to, the following:

To Provide the Platform and Manage Your Account

We use your personal information to establish, administer and maintain your InScape Account and to provide you with access to the Platform and its features. This includes using your information to:

  • Create and authenticate your Account
  • Verify your identity where required
  • Administer your Membership
  • Process Membership renewals and Campaign Access Package purchases
  • Issue Campaign Credits to your Campaign Wallet
  • Record Campaign Credit allocations and transaction history
  • Administer Campaign participation
  • Determine eligibility for Campaigns, Membership Benefits and Partner Offers
  • Process Campaign prize claims and fulfilment
  • Manage referrals and promotional activities
  • Communicate with you regarding your Account, Membership, Campaigns and Platform activity
  • Provide customer support and respond to enquiries, feedback and complaints.

Where necessary, we may also use your information to verify your eligibility before awarding Campaign prizes or providing Member Benefits

To Operate and Improve the Platform

We continually review and improve the functionality, security and performance of the Platform. Your information may be used to:

  • Understand how Members interact with the Platform
  • Improve navigation and user experience
  • Optimize Campaign presentation and discovery
  • Improve Membership features and benefits
  • Enhance the Partner Offers Hub
  • Improve Campaign Explorer functionality
  • Develop new Platform features
  • Monitor system performance
  • Identify software defects
  • Conduct testing and quality assurance activities
  • Undertake research, reporting and business analysis.

Where practical, reporting and analytical information is aggregated or de-identified before being used for these purposes.

To Personalize Your Experience

We may use information relating to your activity on the Platform to personalize your experience and present content that is more relevant to your interests. This may include displaying:

  • Campaigns that may be relevant to your previous participation
  • Partner Offers that align with your interests
  • Membership recommendations
  • Campaign Access Package recommendations
  • Promotional opportunities
  • Platform announcements
  • Other content intended to improve your experience.

Personalization is intended solely to improve the relevance and usability of the Platform and is not used to make automated decisions that produce legal or similarly significant effects.

To Communicate With You

We may use your personal information to communicate with you regarding your use of the Platform. Communications may include:

  • Account verification
  • Membership confirmations
  • Membership renewal reminders
  • payment confirmations
  • Campaign confirmations
  • Campaign winner notifications
  • Campaign closing reminders

  • password reset requests

  • Other communications necessary for the administration and operation of the Platform.

Where permitted by applicable law, we may also send you marketing communications relating to Campaigns, Memberships, Partner Offers, promotions and Platform updates. You may manage your marketing communication preferences at any time through your Account settings or by following the unsubscribe instructions included within marketing communications.

Service-related communications that are necessary to administer your Account or provide the Platform cannot generally be opted out of while your Account remains active.

To Process Payments

We use personal information to process payments relating to Memberships, Campaign Access Packages and other authorized Platform transactions. This includes working with approved third-party payment providers to:

  • Process payments
  • Verify payment information
  • Detect fraudulent transactions
  • Administer recurring Membership payments
  • Process refunds where applicable
  • Investigate payment disputes
  • Manage chargebacks
  • Maintain appropriate financial records.

Payment processing is performed using secure payment technologies and in accordance with applicable payment industry standards.

To Administer Campaigns

Where you participate in a Campaign, we may use your information to administer all aspects of that Campaign. This includes:

  • Recording Campaign participation
  • Recording Campaign Credit allocations
  • Verifying eligibility
  • Conducting winner selection procedures
  • Contacting selected winners
  • Verifying prize claims
  • Arranging prize fulfilment
  • Complying with tax or regulatory reporting obligations where applicable
  • Maintaining appropriate audit records relating to Campaign administration.

To Prevent Fraud and Protect the Platform

Protecting the integrity of the Platform is a fundamental part of our operations. We may use personal information to:

Where necessary, we may suspend or restrict Accounts while investigations are undertaken.

InScape respects your privacy and does not sell your personal information to third parties for their own independent marketing purposes. We may disclose your personal information only where reasonably necessary to operate the Platform, provide the services you have requested, fulfil our contractual obligations, comply with applicable laws or protect our legitimate business interests.

Any disclosure of personal information is undertaken in accordance with this Privacy Policy, applicable privacy laws and appropriate contractual, organizational and technical safeguards. The categories of third parties with whom we may disclose personal information include the following:

Disclosure to Our Service Providers

InScape engages trusted third-party service providers to perform services on our behalf that are necessary for the operation, administration and improvement of the Platform.

Where required, we may disclose personal information to service providers performing functions including:

  • Cloud hosting and infrastructure services

  • Identity verification
  • Fraud prevention
  • Customer support

Disclosure to Direct Partners

The Platform includes a Partner Offers Hub featuring products, services and experiences offered by approved Direct Partners. Where you choose to access, redeem or purchase a Partner Offer, InScape may disclose information reasonably necessary to facilitate that transaction. Depending on the nature of the Partner Offer, this information may include your:

  • Name
  • Email address
  • Membership status
  • Eligibility status
  • Transaction reference
  • Redemption information
  • Other information reasonably required to provide the requested product or service.

Direct Partners remain independently responsible for their own products, services, customer support and privacy practices. Members are encouraged to review the privacy policies of Direct Partners before completing transactions with those businesses.

Disclosure to Affiliate Partners

Certain Partner Offers are made available through approved Affiliate Partners or affiliate marketing networks. Where you choose to access an Affiliate Partner offer through the Platform, limited information may be disclosed where reasonably necessary to:

  • Validate referrals
  • Attribute transactions
  • Administer affiliate commissions
  • Verify purchases
  • Prevent fraud
  • Facilitate the Partner Offer.

This information may include unique transaction identifiers, referral identifiers, campaign identifiers and other technical information required to administer the affiliate relationship. Affiliate Partners remain responsible for their own privacy practices once you leave the InScape Platform and interact directly with their services.

Disclosure Relating to Campaign Administration

Where reasonably necessary to administer Campaigns, verify winners or fulfil prizes, InScape may disclose personal information to third parties involved in Campaign administration. Depending on the Campaign, this may include:

  • Prize suppliers
  • Vehicle dealerships
  • Travel providers
  • Accommodation providers
  • Event organizers
  • Insurers
  • Freight and logistics providers
  • Legal advisers
  • Accountants
  • Taxation advisers
  • Other organizations involved in prize verification or fulfilment.

Only information reasonably necessary to administer the Campaign or fulfil the prize will be disclosed.

Disclosure for Payment Processing

Payments for Memberships, Campaign Access Packages and other authorized purchases are processed through approved third-party payment providers. InScape may disclose information reasonably necessary to:

  • Authorize payments
  • Process recurring Membership payments
  • Investigate payment disputes
  • Administer refunds
  • Prevent payment fraud
  • Comply with financial reporting obligations
  • Meet applicable payment industry requirements.

Payment providers process personal information in accordance with their own privacy policies and applicable laws.

Disclosure Required by Law

InScape may disclose personal information where we reasonably believe disclosure is necessary to:

  • Comply with applicable laws or regulations
  • Comply with court orders or legal process

  • Protect the rights, safety or property of InScape, our Members or third parties

Corporate Transactions

If InScape undergoes or proposes a merger, acquisition, business restructuring, financing, sale of assets or similar corporate transaction, personal information may be disclosed to prospective purchasers, investors, advisers or other relevant parties for the purposes of evaluating and completing that transaction.

Any recipient of such information will be required to maintain its confidentiality and use it only for purposes associated with the proposed transaction. Should ownership of the Platform change, the successor organization will continue to use personal information in accordance with this Privacy Policy or provide Members with notice of any material changes.

De-Identified and Aggregated Information

InScape may create aggregated, statistical or de-identified information that does not reasonably identify any individual Member. Such information may be used for:

  • Platform improvement
  • Reporting
  • Business planning
  • Analytics
  • Product development
  • Research
  • Operational purposes.

Aggregated or de-identified information does not constitute personal information and may be shared without restriction where permitted by applicable law.

Information We Do Not Sell

Except where a disclosure is legally characterized otherwise under applicable privacy legislation, InScape does not sell personal information to third parties for their independent commercial marketing purposes.

Any disclosures made to service providers, Direct Partners, Affiliate Partners or other authorized third parties are made solely for the purpose of operating the Platform, administering Memberships, Campaigns, Campaign Credits, Campaign Access Packages, Partner Offers and other services requested by Members

Your Choices

InScape believes that Members should have meaningful control over their personal information and communication preferences. Subject to applicable laws and the operational requirements of the Platform, you may manage certain personal information, communication preferences and privacy settings through your InScape Account or by contacting us using the details provided in this Privacy Policy.

Certain information is necessary for the operation of the Platform and cannot be removed or disabled while your Account remains active.

Updating Your Account Information

Members are responsible for ensuring that the personal information associated with their Account remains accurate, complete and current. You may update certain Account information at any time by logging into your InScape Account and accessing your Account Settings.

Information that may generally be updated includes:

  • Your name
  • Contact details
  • Password
  • Communication preferences
  • Other profile information made available through the Platform.

Certain information, including identity verification records, Campaign participation records, Membership history and financial transaction records, may not be editable where required to maintain the integrity, security or legal compliance of the Platform.

Marketing Communications

From time to time, InScape may send you marketing communications relating to:

  • Memberships
  • Campaigns
  • Campaign Access Packages
  • Partner Offers
  • Promotional campaigns
  • New Platform features
  • Member Benefits
  • Other products or services that may be of interest to you.

You may withdraw your consent to receive marketing communications at any time by:

  • Selecting the unsubscribe option included within the communication
  • Updating your communication preferences within your Account
  • Contacting InScape directly.

The withdrawal of marketing consent does not affect the lawfulness of communications sent before your request was received.

Service Communications

Certain communications are necessary for the administration, security and operation of the Platform. These communications may include:

  • Account verification
  • Password reset requests
  • Membership confirmations
  • Membership renewal notices
  • Payment confirmations
  • Campaign participation confirmations
  • Campaign winner notifications
  • Campaign Credit activity
  • Security alerts
  • Fraud prevention notices
  • Legal notices
  • Updates to these Terms & Conditions or this Privacy Policy
  • Other communications necessary for the operation of your Account.

Because these communications are essential to the operation of the Platform, they cannot generally be disabled while your Account remains active.

Push Notifications

Where you install the InScape mobile application, you may elect to receive push notifications regarding Campaigns, Memberships, Partner Offers, Campaign Credit activity and other Platform events.

Push notification preferences may be managed through your mobile device settings or, where available, through the notification preferences within the Platform. Disabling push notifications may affect your ability to receive time-sensitive Campaign or Membership information.

SMS Communications

Where you have provided a mobile telephone number and consented to receive SMS communications, InScape may send text messages relating to:

  • Account verification
  • Security authentication
  • Membership renewals
  • Campaign notifications
  • Prize notifications
  • Customer support
  • Other operational communications.

You may withdraw your consent to receive marketing SMS communications at any time by following the opt-out instructions contained within the message or by updating your Account preferences. Operational SMS messages necessary for the administration or security of your Account may continue where permitted by applicable law.

Cookies and Similar Technologies

The Platform uses cookies and similar technologies to improve functionality, maintain security, remember Member preferences, analyze Platform performance and enhance the overall user experience.

Where required by applicable law, you may manage your cookie preferences through your browser settings or any cookie consent tools made available by InScape. Please note that disabling certain cookies may affect the availability or functionality of some features of the Platform.

Location Information

Where your device permits the sharing of location information, you may withdraw or modify that permission through your device settings. Disabling location permissions may affect certain Platform features that rely upon regional or location-based functionality.

Data Collection Preferences

You may choose not to provide certain personal information requested by InScape.

However, some information is necessary for the establishment of an Account, the administration of Memberships, participation in Campaigns, identity verification, prize fulfilment, payment processing and compliance with applicable laws. If you choose not to provide information required for these purposes, some features of the Platform may become unavailable or your ability to use the Platform may be limited.

Account Closure

You may request the closure of your InScape Account at any time. Closure of an Account does not automatically remove or delete personal information that InScape is required to retain for legal, regulatory, financial, fraud prevention or contractual purposes.

Information retained following Account closure will be managed in accordance with this Privacy Policy and applicable laws.

Your Privacy Rights

Subject to applicable privacy laws and any lawful exceptions, you may have certain rights in relation to the personal information that InScape collects, processes, stores and discloses about you. These rights may vary depending upon your country, state or jurisdiction of residence.

Where required by applicable law, InScape will respond to verified privacy requests within the timeframes prescribed by law.

Right to Know and Access

You may request confirmation as to whether InScape collects or processes personal information relating to you.

Where permitted by applicable law, you may also request access to the personal information we hold about you, including information relating to:

  • The purposes for which your personal information has been collected, used or disclosed
  • The categories of third parties with whom personal information has been disclosed
  • The sources from which personal information has been obtained
  • The specific personal information maintained by InScape about you.

Right to Correct

You have the right to request correction of inaccurate or incomplete personal information maintained by InScape. Where reasonably possible, Members should first update their personal information through their Account Settings.

Where information cannot be updated through the Platform, you may contact InScape and request that the information be corrected. InScape may request additional information to verify your identity before making any correction.

Right to Request Deletion

Subject to applicable laws and any legal exceptions, you may request that InScape delete personal information we hold about you. Upon receiving a verified request, we will delete your personal information unless we are required or permitted to retain it for purposes including:

  • Compliance with legal obligations
  • Taxation and financial reporting
  • Fraud prevention
  • Security investigations
  • Dispute resolution
  • Enforcement of our Terms & Conditions
  • Campaign administration
  • Prize verification and fulfilment
  • Membership and payment records
  • Campaign Wallet transaction records
  • Any other lawful business purpose permitted under applicable law.

Where deletion cannot be completed, we will inform you of the legal basis for retaining the information where required by law.

Right to Data Portability

Where required by applicable law, you may request a copy of certain personal information that you have provided to InScape.

Where technically feasible, we will provide that information in a structured, commonly used and machine-readable format suitable for transfer to another service provider. This right applies only where required by applicable law and may be subject to legal limitations and exceptions.

Right to Withdraw Consent

Where InScape relies upon your consent to process personal information, you may withdraw that consent at any time.

Withdrawal of consent does not affect the lawfulness of any processing undertaken prior to the withdrawal. Please note that withdrawing consent for certain types of processing may limit your ability to access some features or services offered through the Platform.

Right to Opt-Out of Marketing Communications

You may opt out of receiving promotional communications from InScape at any time by:

  • Selecting the unsubscribe link contained within our communications
  • Updating your communication preferences within your Account
  • Contacting InScape directly.

Even where you opt out of marketing communications, InScape may continue to send communications necessary for the administration, security and operation of your Account.

Right to Lodge a Complaint

If you believe that InScape has processed your personal information in a manner that does not comply with applicable privacy laws, you may submit a complaint by contacting us using the details provided within this Privacy Policy.

We will investigate complaints in good faith and endeavour to respond within a reasonable period. Where applicable law provides additional rights, you may also lodge a complaint with the relevant privacy regulator or supervisory authority within your jurisdiction.

Verification of Requests

To protect the privacy and security of our Members, InScape may require you to verify your identity before responding to requests relating to your personal information.

Verification procedures may include confirming your identity through your Account, requesting additional identifying information or requiring documentation reasonably necessary to confirm that the request has been made by the individual concerned or their authorized representative.

Where identity cannot be reasonably verified, InScape may decline the request to protect personal information from unauthorized access.

Authorized Representatives

Where permitted by applicable law, you may appoint an authorized representative to submit privacy requests on your behalf. InScape may require reasonable evidence of that person's authority to act for you and may also require independent verification of your identity before processing the request.

International Privacy Rights

InScape recognizes that Members located in different jurisdictions may have additional privacy rights under applicable laws. Where required, InScape will comply with applicable privacy legislation, including, where relevant:

  • United States privacy laws, including applicable state privacy legislation
  • Canada's Personal Information Protection and Electronic Documents Act (PIPEDA)
  • Australia's Privacy Act 1988 (Cth)
  • New Zealand's Privacy Act 2020
  • The European Union's General Data Protection Regulation (GDPR), where applicable.

Nothing in this Privacy Policy limits any mandatory rights available under applicable privacy legislation.

Response Timeframes

InScape will respond to verified privacy requests within the timeframes required by applicable law. Where additional time is reasonably required due to the complexity or volume of a request, we may extend the response period where permitted by law and will notify you accordingly.

Other Notices

Notice Regarding Minors

The InScape Platform is intended solely for individuals who are at least eighteen (18) years of age, or such higher minimum age as may be required by the laws of the jurisdiction in which a Member resides or participates in a Campaign. We do not knowingly collect personal information from children or individuals who are not legally permitted to create an InScape Account.

If we become aware that personal information has been collected from an individual who is not eligible to use the Platform without the necessary legal authority or parental consent where required by applicable law, we will take reasonable steps to delete that information or otherwise comply with our legal obligations.

Parents, guardians or individuals who believe that personal information has been collected contrary to this section should contact InScape immediately using the contact details provided within this Privacy Policy.

Retention of Personal Information

InScape retains personal information only for as long as reasonably necessary to fulfil the purposes described in this Privacy Policy, to administer the Platform, comply with legal obligations, resolve disputes, enforce our contractual rights and protect the integrity and security of the Platform.

The period for which personal information is retained will depend upon the nature of the information, the purpose for which it was collected and any legal or regulatory obligations requiring its continued retention. Without limitation, InScape may retain information relating to:

  • Account registration and profile information
  • Membership records
  • Campaign Access Package purchases
  • Campaign Wallet activity
  • Campaign Credit issuance and allocation history
  • Campaign participation records
  • Winner verification documentation
  • Prize fulfilment records
  • Payment and billing records
  • Referral activity
  • Customer support communications
  • Fraud investigations
  • Security incidents
  • Legal claims
  • Taxation and accounting obligations
  • Audit and compliance records.

Where personal information is no longer required, InScape will securely delete, anonymize or de-identify the information in accordance with applicable laws and our internal data retention policies.

InScape is committed to protecting the confidentiality, integrity and availability of the personal information entrusted to us. While InScape employs industry-standard security measures, no method of electronic transmission or storage can be guaranteed to be completely secure. Accordingly, InScape cannot guarantee the absolute security of information transmitted to or stored by the Platform.

Members are responsible for maintaining the confidentiality of their Account credentials and should notify InScape immediately if they become aware of any unauthorized access or suspected compromise of their Account.

Fraud Prevention and Platform Integrity

Protecting the integrity of the Platform, Campaigns and Membership services is fundamental to InScape's operations. We may collect, analyze and process personal information for the purposes of:

  • Detecting fraudulent activity
  • Identifying duplicate or false Accounts
  • Investigating payment fraud
  • Monitoring suspicious Campaign participation
  • Preventing referral abuse
  • Detecting automated or bot activity
  • Protecting Campaign integrity
  • Investigating suspected breaches of our Terms & Conditions
  • Complying with legal obligations
  • Protecting the rights, property and security of InScape, our Members and third parties.

Where reasonably necessary, information may be shared with authorized service providers, payment providers, legal advisers, law enforcement agencies or regulatory authorities in accordance with applicable law.

International Transfers of Personal Information

InScape may store or process personal information using service providers or infrastructure located in jurisdictions outside the country in which you reside. Where personal information is transferred internationally, InScape will take reasonable steps to ensure that appropriate safeguards are implemented to protect personal information in accordance with applicable privacy laws.

Such safeguards may include contractual protections, recognized international transfer mechanisms or other legally approved measures. By using the Platform, you acknowledge that your personal information may be transferred, processed and stored in jurisdictions that may have privacy laws different from those in your country of residence.

Phishing and Fraudulent Communications

InScape will never request your password, complete payment card details or sensitive security credentials through unsolicited email, SMS or telephone communications. If you receive a communication that appears to originate from InScape requesting confidential information or directing you to an unfamiliar website, you should not respond, click any links or provide any information.

Suspected phishing attempts or fraudulent communications should be reported to InScape immediately using the contact details published on the Platform.

Business Continuity and Disaster Recovery

InScape maintains policies and procedures designed to support the continuity, availability and recovery of the Platform in the event of technical failures, cybersecurity incidents, infrastructure outages or other operational disruptions.

Compliance with Applicable Laws

InScape operates the Platform with the intention of complying with applicable privacy, consumer protection, payment, taxation and promotional laws within the jurisdictions in which the Platform is made available.

Where reasonably necessary, InScape may collect, retain, disclose or process personal information in order to comply with applicable legal obligations, regulatory requirements, court orders or lawful requests made by government authorities.
