1. Introduction & Acceptance of Terms
These Terms and Conditions ("Terms") govern your access to and use of the InScape platform, including our website, mobile applications, software, services, promotional campaigns, memberships, Campaign Access Packages, Partner Offers Hub and any other products or services made available by InScape (collectively, the "Platform").
By creating an account, purchasing a membership, purchasing a Campaign Access Package, participating in a Campaign, accessing Partner Offers, or otherwise using the Platform, you acknowledge that you have read, understood and agree to be legally bound by these Terms, our Privacy Policy, and any applicable Official Campaign Rules.
If you do not agree to these Terms, you must not access or use the Platform.
These Terms constitute a legally binding agreement between you ("Member", "User" or "you") and InScape ("InScape", "we", "our" or "us").
1.1 Eligibility
To create an InScape account as a User or participate in any Campaign, you must:
- Be at least eighteen (18) years of age.
- Have the legal capacity to enter into a binding agreement.
- Provide accurate, complete and current registration information.
- Maintain only one (1) personal account unless otherwise expressly authorized by InScape.
- Comply with these Terms, the Privacy Policy and any applicable Official Campaign Rules.
InScape reserves the right to suspend, restrict or terminate any account that contains false information, duplicate registrations or activity that breaches these Terms.
1.2 Acceptance of Terms
By creating an account or using the Platform, you acknowledge and agree that:
- You have read and accepted these Terms.
- You have read and accepted the Privacy Policy.
- You agree to comply with any Official Campaign Rules applicable to individual Campaigns.
- You consent to receiving service-related communications necessary for the operation of your account.
- You understand that participation in Campaigns is subject to eligibility requirements and any applicable laws.
Your acceptance of these Terms will be electronically recorded together with the applicable version number, date and time of acceptance.
1.3 Changes to these Terms
InScape may update these Terms from time to time to reflect changes to the Platform, applicable laws, business operations or our services.
Where changes materially affect your rights or obligations, we will provide reasonable notice through the Platform, email or other appropriate communication methods. Your continued use of the Platform after revised Terms become effective constitutes your acceptance of those revised Terms.
If you do not agree to any revised Terms, you must discontinue using the Platform and may close your account at any time.
1.4 Additional Policies
These Terms should be read together with the following documents, which form part of this Agreement where applicable:
- Privacy Policy
- Official Campaign Rules
- Membership Information
- Campaign Access Package Information
- Partner Offer Terms (where applicable)
- Any campaign-specific terms published on the Platform
Where a conflict exists between these Terms and the Official Campaign Rules for a specific Campaign, the Official Campaign Rules will prevail only in relation to that Campaign.
2. Definitions
For the purposes of these Terms and Conditions, the following definitions apply unless the context otherwise requires:
- ACCOUNT - An Account is a registered user profile created to access the InScape Platform, participate in Campaigns, purchase Memberships or Campaign Access Packages, access Partner Offers and manage account settings.
- CAMPAIGN - A Campaign is a promotional opportunity made available through the InScape Platform in which eligible Members may allocate Campaign Credits in accordance with these Terms and the applicable Official Campaign Rules.
- CAMPAIGN CREDITS - Campaign Credits are non-monetary participation credits which are included as a Membership Benefit issued by InScape. Campaign Credits may be received through Memberships, Campaign Access Packages, promotional activities, referrals or other approved methods. Campaign Credits: have no cash value; are not redeemable for cash; cannot be transferred between Members unless expressly authorized by InScape; may only be used to participate in eligible Campaigns; are subject to these Terms and any applicable Official Campaign Rules.
- CAMPAIGN ACCESS PACKAGE - A Campaign Access Package is a one-time purchase that provides a specified number of Campaign Credits for use across eligible active Campaigns. Campaign Access Packages are separate from Memberships and do not provide recurring Campaign Credits or Member Benefits unless expressly stated.
- MEMBERSHIP - A Membership is a recurring subscription that provides Members with monthly (or yearly) Campaign Credit allocations and access to Member Benefits available under their selected Membership plan. Memberships may be offered on monthly or annual billing cycles.
- FREE ACCOUNT - A Free Account is a non-subscription account that allows eligible users to access selected Platform features and participate in Campaigns using available Campaign Credits, subject to these Terms.
- MEMBER BENIFITS - Member Benefits are additional features, services and privileges available to eligible paid Members. These may include monthly Campaign Credit allocations, access to the Partner Offers Hub, exclusive promotions, early campaign notifications and other benefits determined by InScape. Member Benefits may change from time to time without affecting existing contractual rights.
- PARTNER - A Partner is a business or organization approved by InScape to promote products, services or experiences through the Partner Offers Hub.
- PARTNER OFFERS HUB - The Partner Offers Hub is the section of the Platform where eligible Members may browse and access offers, promotions, discounts, bookings, experiences or services provided by approved Partners. Unless otherwise specified, Partner Offers are fulfilled directly by the respective Partner and not by InScape.
- AFFILIATE PARTNER - An Affiliate Partner is a third-party business whose offers are made available through approved affiliate networks or affiliate relationships managed by InScape.
- DIRECT PARTNER - A Direct Partner is a business that has entered into a direct commercial relationship with InScape to promote offers or services through the Platform.
- OFFICIAL CAMPAIGN RULES - Official Campaign Rules are the campaign-specific terms governing eligibility, participation requirements, Campaign periods, prize details, winner selection, prize fulfilment and any additional conditions applicable to an individual Campaign. Official Campaign Rules form part of these Terms for the relevant Campaign.
- PLATFORM - The Platform means the InScape website, mobile applications, progressive web application (PWA), software, APIs, services, communications and any other digital services operated by InScape.
- USER - A User is any individual who accesses or uses the Platform, whether registered or unregistered.
- MEMBER - A Member is a registered User who has successfully created an InScape Account.
- ACTIVE MEMBERSHIP - An Active Membership is a Membership that is current, fully paid and not suspended, cancelled or otherwise terminated.
- CAMPAIGN WALLET - The Campaign Wallet is the Member's account balance showing available Campaign Credits together with a complete transaction history of Campaign Credit allocations, purchases, grants and adjustments.
- MONTHLY MOMENTUM - Monthly Momentum is InScape's engagement program that rewards eligible Members for completing qualifying activities during a monthly engagement period, in accordance with the rules determined by InScape.
- CAMPAIGN EXPLORER - Campaign Explorer is an engagement feature that rewards Members for participating across multiple eligible Campaigns during a qualifying period.
- BUSINESS DAY - Business Day means any day other than a Saturday, Sunday or public holiday in the State of Florida, United States.
3. Platform Overview
3.1 About InScape
InScape is a membership platform designed to provide Members with access to promotional Campaigns, recurring Membership Benefits and Partner Offers.
Membership fees are paid in consideration for the Membership services and benefits provided by InScape, which may include recurring Campaign Credit allocations, access to the Partner Offers Hub, exclusive member promotions and other Membership Benefits made available from time to time.
Campaign Credits provided through a Membership, are a Membership Benefit and are not separately purchased.
The Platform is designed to deliver a premium member experience by combining Campaign participation, recurring Membership value and curated Partner Offers within a single digital ecosystem.
3.2 How the Platform Works
Members may participate in Campaigns by allocating available Campaign Credits to eligible active Campaigns. Campaign Credits may be obtained through one or more of the following methods:
- Complimentary Campaign Credits issued to eligible Free Accounts.
- Free Monthly Campaign Credit allocations through an active Membership.
- The purchase of Campaign Access Packages.
- Approved promotional activities.
- Referral rewards.
- Other methods determined by InScape.
Campaign Credits may only be used in accordance with these Terms and the applicable Official Campaign Rules.
3.3 Campaign Participation
Each Campaign published on the Platform will include information including, where applicable:
- Campaign title.
- Prize details.
- Campaign opening and closing dates.
- Eligibility requirements.
- Campaign Credit allocation requirements.
- Winner selection process.
- Any applicable Official Campaign Rules.
Participation in a Campaign does not guarantee that a Member will be selected as a winner.
3.4 Partner Offers Hub
Eligible Members may access the Partner Offers Hub to discover products, services, discounts, experiences and other offers made available by approved Partners. Partner Offers are provided by independent businesses.
Unless expressly stated otherwise:
- InScape is not the supplier of Partner products or services.
- InScape does not guarantee Partner pricing, availability or fulfilment.
- Any purchase or booking made through a Partner is a separate agreement between the Member and the Partner.
3.5 Platform Availability
While InScape aims to provide continuous access to the Platform, we do not guarantee uninterrupted availability. Access may occasionally be interrupted due to:
- Scheduled maintenance.
- Software updates.
- Security improvements.
- Third-party service interruptions.
- Technical failures.
- Events beyond our reasonable control.
InScape will use reasonable efforts to restore normal operation as soon as practicable.
3.6 Platform Changes
InScape may introduce, modify, suspend or discontinue Platform features, Campaigns, Membership Benefits, Partner Offers or other services at any time. Where practical, Members will be provided with reasonable notice of material changes.
3.7 No Guarantee of Availability
The publication of any Campaign, Membership Plan, Campaign Access Package or Partner Offer does not guarantee its continued availability. InScape reserves the right to:
- Add or remove Campaigns.
- Amend Campaign schedules.
- Modify Membership Plans.
- Introduce new Campaign Access Packages.
- Add or remove Partners.
- Update Member Benefits.
- Discontinue Platform features.
Where such changes materially affect an active Campaign or Membership, InScape will act reasonably and in accordance with these Terms and any applicable laws.
3.8 Platform Time Standard
All Campaigns, Membership renewals, Campaign Credit allocations, Monthly Momentum periods, Campaign Explorer periods, campaign countdowns and other time-based Platform events operate using the official InScape platform timezone of Eastern Time (America/ Florida).
User devices may display dates and times in the Member's local timezone for convenience; however, all Platform calculations, eligibility requirements, Campaign opening and closing times, Membership events and other time-sensitive activities are determined exclusively using the official InScape platform timezone.
3.9 Platform Discretion
InScape reserves the right to investigate, review and take appropriate action where it reasonably believes a User has:
- Breached these Terms
- Attempted to manipulate the Platform
- Engaged in fraudulent or deceptive conduct
- Compromised Platform security
- Abused Campaigns, Memberships, Campaign Credits or Partner Offers.
Such action may include suspension, restriction or permanent termination of an Account without prejudice to any other rights available to InScape under these Terms or applicable law.
4. Eligibility & Account Registration
4.1 Eligibility
To create an InScape Account or participate in any Campaign, you must:
- Be at least eighteen (18) years of age.
- Have the legal capacity to enter into a binding agreement.
- Reside in a jurisdiction where participation in the applicable Campaign is permitted.
- Provide accurate, current and complete information during registration.
- Accept these Terms & Conditions, the Privacy Policy and any applicable Official Campaign Rules.
InScape reserves the right to request additional information to verify your identity, age or eligibility at any time.
4.2 Account Registration
To access certain features of the Platform, you must create an InScape Account. Registration may require you to provide information including:
- Full name
- Email address
- Password
- Date of birth
- Country and State of residence
- Cell number (where applicable)
Additional information may be requested where reasonably required for identity verification, Campaign participation, prize fulfilment or legal compliance.
4.3 One Account Per Person
Each individual may register and operate only one (1) personal InScape Account unless otherwise approved by InScape in writing. Creating multiple accounts, operating accounts on behalf of another person or attempting to circumvent this restriction may result in:
- Suspension of one or more Accounts
- Removal from Campaigns
- Forfeiture of Campaign Credits
- Cancellation of Memberships
- Permanent exclusion from the Platform.
4.4 Account Security
You are responsible for maintaining the confidentiality of your login credentials and for all activity occurring under your Account. You agree to:
- Keep your password secure.
- Notify InScape immediately if you suspect unauthorized access.
- Log out of shared or public devices.
- Take reasonable precautions to protect your Account.
InScape is not responsible for losses resulting from your failure to adequately protect your login credentials.
4.5 Accurate Information
You agree that all information provided to InScape is true, accurate and complete. You must promptly update your Account if your information changes. Providing false, misleading or fraudulent information may result in:
- Suspension or termination of your Account.
- Cancellation of Campaign participation.
- Forfeiture of Campaign Credits.
- Cancellation of Membership benefits.
- Refusal to award or deliver prizes.
4.6 Identity Verification
InScape may require Members to complete identity verification before:
- Receiving certain Member Benefits.
- Participating in selected Campaigns.
- Claiming a prize.
- Processing refunds.
- Reinstating a suspended Account.
Verification may include requesting government-issued identification or other reasonable documentation. Failure to complete requested verification may result in restricted access to certain Platform features.
4.7 Account Suspension
InScape may temporarily suspend an Account while investigating suspected:
- Fraud.
- Duplicate accounts.
- Identity concerns.
- Payment disputes.
- Breaches of these Terms.
- Platform manipulation.
- Suspicious or unusual activity.
During suspension, access to some or all Platform features may be restricted.
4.8 Account Termination
InScape may permanently terminate an Account where it reasonably determines that a User has:
- Breached these Terms.
- Engaged in fraudulent conduct.
- Manipulated Campaigns or Campaign Credits.
- Used automated systems or bots.
- Misrepresented their identity.
- Attempted to interfere with the operation of the Platform.
- Engaged in unlawful activity through the Platform.
Termination may result in the loss of access to Memberships, Campaign Credits, Member Benefits and other Platform services, subject to applicable law.
4.9 Acceptance of Updated Terms
Where InScape introduces updated Terms & Conditions, Members may be required to accept the revised Terms before continuing to use certain Platform features. Failure to accept updated Terms may limit or prevent continued access to the Platform.
4.10 Electronic Records
By creating an Account, you consent to InScape maintaining electronic records of:
- Your registration.
- Acceptance of these Terms.
- Acceptance of the Privacy Policy.
- Acceptance of Official Campaign Rules where applicable.
- Membership purchases.
- Campaign Access Package purchases.
- Campaign Credit transactions.
- Campaign participation.
- Platform communications.
These records may be relied upon by InScape as evidence of your use of the Platform and your acceptance of these Terms.
5. Memberships
5.1 Membership Overview
InScape offers recurring Membership plans designed to provide Members with ongoing Campaign Credits and access to exclusive Member Benefits. Memberships are separate from Campaign Access Packages and operate on a recurring subscription basis. An active Membership may include benefits such as:
- Monthly Campaign Credit allocations.
- Access to the Partner Offers Hub.
- Exclusive Member promotions.
- Priority access to selected Campaigns.
- Early campaign notifications.
- Other Member Benefits as determined by InScape.
Membership benefits vary depending on the Membership plan selected.
5.2 Membership Plans
Memberships are recurring subscription services that provide ongoing Platform benefits. Members subscribe to receive access to the Membership services and benefits offered by InScape, including recurring Campaign Credit allocations and other Membership Benefits. A Membership is not the purchase of a prize, an opportunity to win a prize or the purchase of Campaign Credits.
InScape may offer multiple Membership plans with different pricing, Campaign Credit allocations and Member Benefits. Current Membership plans, pricing and included benefits are published on the Platform and may be updated from time to time. Membership pricing displayed at the time of purchase forms part of your Membership agreement.
Eligible users may create a Free Account without charge. Free Account holders may receive complimentary Campaign Credits and participate in eligible Campaigns in accordance with these Terms and the applicable Campaign Rules. No Membership purchase is required to create a Free Account.
5.3 Monthly Campaign Credit Allocations
Members with an Active Membership will receive the Campaign Credit allocation applicable to their Membership plan during each successful billing cycle. Campaign Credits are issued only after successful payment has been processed. Campaign Credit allocations are:
- Non-transferable.
- Non-refundable.
- Issued electronically.
- Recorded within the Member's Campaign Wallet.
5.4 Membership Renewals
Memberships automatically renew at the end of each billing period unless cancelled before the next renewal date. By purchasing a Membership, you authorize InScape to automatically charge your nominated payment method for each recurring billing cycle until your Membership is cancelled.
Renewal dates are calculated using the official InScape Platform timezone (Eastern Time – America/ Florida).
5.5 Failed Payments
If a scheduled Membership renewal payment cannot be successfully processed, the Member will enter a Grace (Past Due) status. During the Grace Period:
- InScape will make reasonable attempts to collect the outstanding payment.
- The Member will receive notifications requesting payment details be updated where required.
- No new Campaign Credits will be issued until payment is successfully received.
- Access to Member-only benefits, including the Partner Offers Hub and other premium Platform features, may be suspended.
Campaign Credits previously issued before the failed renewal remain subject to InScape's Campaign Credit policy.
5.6 Cancellation Following Failed Payments
If InScape is unable to successfully process Membership renewal payments after three (3) consecutive payment attempts, the Membership may be automatically cancelled. Upon cancellation:
- Monthly Campaign Credit allocations cease.
- Member-only benefits cease.
- Access to premium Membership features is removed.
- The Member may reactivate their Membership by completing a successful payment.
5.7 Member Cancellation
Members may cancel their Membership at any time through their Account settings. Unless otherwise required by applicable law:
- Cancellation takes effect at the end of the current billing period.
- Membership fees already paid are non-refundable.
- Members continue to receive Membership benefits until the current billing period expires.
- No further recurring charges will occur after cancellation becomes effective.
5.8 Membership Reactivation
A cancelled Membership may be reactivated at any time by purchasing a new Membership through the Platform. InScape reserves the right to determine whether previously earned Member status, promotional entitlements or loyalty benefits (if applicable) are reinstated.
5.9 Membership Changes
Members may upgrade or downgrade their Membership plan at any time, subject to the Membership options available on the Platform. Where a Membership plan changes:
- The revised Membership fee will be displayed before confirmation.
- Any changes to Campaign Credit allocations or Member Benefits will be communicated before the change takes effect.
- Billing adjustments may apply depending on the timing of the plan change.
5.10 Membership Benefits
Membership Benefits are provided at InScape's discretion and may evolve as the Platform develops. Benefits may include:
- Campaign Credit allocations.
- Partner Offers.
- Exclusive Campaigns.
- Early campaign access.
- Promotional opportunities.
- Priority notifications.
- Other Member-exclusive services.
Certain benefits may be available only to specific Membership plans.
5.11 Membership Misuse
InScape reserves the right to suspend or terminate a Membership where it reasonably believes a Member has:
- Obtained Membership benefits fraudulently.
- Shared Membership access with another person.
- Manipulated Campaign Credit allocations.
- Abused promotional offers.
- Breached these Terms.
Such action may occur without refund where permitted by law.
5.12 Membership Availability
InScape reserves the right to:
- Introduce new Membership plans.
- Retire existing Membership plans.
- Modify Membership pricing.
- Change Member Benefits.
- Introduce promotional Membership offers.
Changes will not affect existing contractual rights unless permitted by these Terms or required by law.
6. Campaign Access Packages
6.1 Campaign Access Packages
InScape may offer optional Campaign Access Packages that include a specified allocation of Campaign Credits for use across eligible active Campaigns.
Campaign Access Packages are one-time purchases designed to provide additional participation opportunities and are separate from recurring Memberships. The purchase of a Campaign Access Package does not create a Membership, provide recurring Campaign Credits or entitle the purchaser to ongoing Member Benefits unless expressly stated.
6.2 Available Packages
InScape may make available a range of Campaign Access Packages from time to time. Each Campaign Access Package includes a specified allocation of Campaign Credits for use across eligible Campaigns. Current Campaign Access Packages, pricing and included Campaign Credit allocations are published on the Platform and may be amended from time to time. Following successful payment, InScape will issue the applicable Campaign Credits to the Member's Campaign Wallet.
6.3 Campaign Credits Included with a Campaign Access Package
Following successful payment, InScape will issue the Campaign Credits included with the selected Campaign Access Package to the Member's Campaign Wallet.
Once issued, those Campaign Credits may be allocated across one or more eligible active Campaigns in accordance with these Terms and the applicable Official Campaign Rules.
6.4 Nature of a Campaign Access Package
Campaign Access Packages are optional one-time purchases that include a specified allocation of Campaign Credits for use across eligible active Campaigns.
Campaign Access Packages are separate from Memberships and:
- Are purchased as a one-time transaction
- Do not automatically renew
- Do not create an ongoing subscription
- Do not provide recurring Campaign Credit allocations
- Do not include Member Benefits unless expressly stated.
Campaign Access Packages are entirely optional. Eligible users may create a Free Account and receive complimentary Campaign Credits without purchasing a Membership or Campaign Access Package. Campaign Access Packages simply provide an additional method of obtaining Campaign Credits for participation in eligible Campaigns.
6.5 Relationship to Memberships
Campaign Access Packages are independent of Memberships and do not affect or modify a Member’s account status.
Purchase of a Campaign Access Package does not:
- Activate a Membership
- Upgrade or modify a Free Account
- Provide access to Member-only benefits
- Grant access to the Partner Offers Hub (unless otherwise expressly stated)
- Create any entitlement to recurring Campaign Credits or ongoing Membership Benefits.
Campaign Access Packages may be purchased by both Free Account users and Members with an Active Membership.
Members with an Active Membership may purchase Campaign Access Packages at any time to supplement their existing Campaign Credit balance.
6.6 Payment
Campaign Access Packages must be paid in full at the time of purchase. Campaign Credits will only be issued to the Member’s Campaign Wallet once payment has been successfully authorized, processed, and confirmed by InScape or its authorized payment provider.
Accepted payment methods are displayed on the Platform and may be updated or changed from time to time.
6.7 Refunds
Unless required by applicable law or expressly approved by InScape, purchases of Campaign Access Packages are non-refundable. Refunds may be considered where:
- A duplicate payment has been processed
- Campaign Credits were not successfully issued due to a Platform error
- A refund is otherwise required by law.
Approved refunds may result in the associated Campaign Credits being removed from the Member's Campaign Wallet where they have not already been allocated to a Campaign.
6.8 Failed Payments
If payment for a Campaign Access Package fails or is declined:
- No Campaign Credits will be issued
- No Campaign participation rights arise from that purchase
- The Member may retry payment using an alternative payment method.
6.9 Promotional Campaign Access Packages
From time to time, InScape may offer promotional Campaign Access Packages with bonus Campaign Credits or additional benefits. Unless otherwise stated, promotional Campaign Credits are subject to the same terms and conditions as standard Campaign Credits.
6.10 Availability
InScape reserves the right to:
- Introduce new Campaign Access Packages
- Retire existing Campaign Access Packages
- Modify Campaign Credit allocations
- Change pricing
- Introduce promotional pricing
- Limit availability of Campaign Access Packages,
without prior notice, except where required by applicable law.
6.11 No Guarantee of Success
The purchase of a Campaign Access Package does not:
- Guarantee participation in every Campaign
- Guarantee selection as a winner
- Improve the probability of winning beyond the Campaign Credits allocated by the Member
- Create any entitlement to prizes or Member Benefits.
Campaign participation remains subject to eligibility requirements and the applicable Official Campaign Rules.
7. Campaign Credits
7.1 Campaign Credits
Campaign Credits are the Platform's participation currency and may be used by eligible Members to participate in active Campaigns. Campaign Credits are issued by InScape and may only be used in accordance with these Terms and the applicable Official Campaign Rules.
Campaign Credits are promotional participation credits issued by InScape. Campaign Credits:
- Have no monetary value
- Cannot be purchased individually
- Cannot be redeemed for cash
- Cannot be exchanged for money
- Cannot be withdrawn from the Platform
- May only be used to participate in eligible Campaigns conducted through the Platform.
- Campaign Credits do not represent currency, stored value, financial instruments or any other proprietary interest.
7.2 Methods of Issuing Campaign Credits
InScape may issue Campaign Credits to eligible Members or Free Account holders through one or more of the following methods:
- Complimentary Campaign Credits issued upon registration of an eligible Free Account.
- Campaign Credits included with an Active Membership.
- Campaign Credits included with a purchased Campaign Access Package.
- Promotional Campaign Credits issued as part of marketing or promotional activities.
- Campaign Credits issued through the Referral Program.
- Bonus Campaign Credits issued as part of Member promotions or engagement initiatives.
- Other promotional or administrative allocations determined by InScape from time to time.
The availability and quantity of Campaign Credits issued through each method are determined by InScape.
7.3 Campaign Wallet
Each Member has a Campaign Wallet that records:
- Current Campaign Credit balance.
- Campaign Credit allocations.
- Membership allocations.
- Campaign Access purchases.
- Promotional Campaign Credits.
- Referral Campaign Credits.
- Adjustments.
- Reversals.
- Transaction history.
The Campaign Wallet represents the official record of a Member's Campaign Credit balance.
7.4 Campaign Credit Transactions
Every Campaign Credit transaction is recorded within the Campaign Wallet. Transactions may include:
- Credits issued.
- Credits allocated.
- Credits reversed.
- Promotional bonuses.
- Administrative adjustments.
- Expired Campaign Credits (if applicable).
- Refund-related reversals.
Members may review their Campaign Credit history through the Platform.
7.5 Allocating Campaign Credits
Campaign Credits may be allocated to one or more eligible Campaigns during the Campaign Period.
Once Campaign Credits have been successfully allocated:
- The allocation becomes part of that Campaign
- The Campaign Credits are deducted from the Member's available balance
- The transaction is recorded in the Campaign Wallet
- The allocation cannot be cancelled except where required by law or expressly authorized by InScape.
7.6 No Monetary Value
Campaign Credits:
- Have no cash value
- Cannot be exchanged for cash
- Cannot be withdrawn
- Cannot be redeemed for money
- Cannot be pledged as security
- Do not accrue interest.
Campaign Credits exist solely for participation within the Platform.
7.7 Transferability
Campaign Credits are personal to the registered Member. Unless expressly authorized by InScape, Campaign Credits:
- cannot be transferred
- cannot be sold
- cannot be gifted
- cannot be exchanged between Members
- cannot be inherited or assigned.
7.8 Campaign Credit Expiry
Campaign Credits issued by InScape may be subject to expiry where specified by:
- the applicable promotion
- Membership conditions
- Campaign Access terms
- Platform rules.
Any applicable expiry period will be disclosed before Campaign Credits are issued. Where no expiry period is specified, Campaign Credits will remain valid until used or otherwise removed in accordance with these Terms.
7.9 Administrative Adjustments
InScape may adjust a Member's Campaign Credit balance where reasonably necessary, including where:
- Duplicate Campaign Credits have been issued
- Payment has been reversed or charged back
- Fraud has been detected
- Administrative errors have occurred
- Campaign Credits have been awarded incorrectly
- A refund has been processed.
Any adjustment will be recorded within the Campaign Wallet.
7.10 Fraudulent Activity
InScape reserves the right to suspend, remove or reverse Campaign Credits where it reasonably believes they have been obtained through:
- Fraudulent conduct
- Payment fraud
- Duplicate accounts
- Referral abuse
- System manipulation
- Automated activity
- Any breach of these Terms.
InScape may also suspend or terminate the associated Account.
7.11 Platform Errors
Where Campaign Credits are issued incorrectly due to a technical, administrative or system error, InScape reserves the right to correct the Member's Campaign Wallet to reflect the intended balance.
Such corrections will not constitute a breach of these Terms.
7.12 Campaign Credit Visibility
Members are responsible for reviewing their Campaign Wallet and notifying InScape within a reasonable time if they believe an error has occurred.
InScape will investigate reported discrepancies in good faith.
7.13 No Property Right
Campaign Credits remain part of the InScape Platform ecosystem. A Member receives a limited contractual right to use Campaign Credits in accordance with these Terms. Campaign Credits do not constitute property, securities, stored value, financial instruments or any other proprietary interest.
7.14 Platform Configuration
InScape reserves the right to modify the manner in which Campaign Credits are issued, allocated, rewarded, calculated or administered, provided such changes do not materially affect Campaign Credits already issued to Members unless required by law or to correct fraud, abuse or system error.
8. Campaign Participation
8.1 Campaign Participation
Eligible Members may participate in active Campaigns by allocating available Campaign Credits during the applicable Campaign Period. Participation in a Campaign is subject to:
- These Terms & Conditions
- The applicable Official Campaign Rules
- Platform eligibility requirements
- Any additional conditions published for the Campaign.
8.2 Campaign Information
Each Campaign will publish information including, where applicable:
- Campaign title.
- Prize description.
- Campaign opening date.
- Campaign closing date.
- Campaign countdown.
- Minimum Campaign Credit allocation (if applicable).
- Eligibility requirements.
- Winner selection process.
- Prize claim requirements.
- Official Campaign Rules.
Campaign information published on the Platform forms part of the applicable Official Campaign Rules.
8.3 Campaign Eligibility
Members are responsible for ensuring they satisfy all eligibility requirements before participating in a Campaign. InScape reserves the right to refuse, cancel or invalidate participation where a Member does not satisfy applicable eligibility requirements.
8.4 Campaign Credit Allocation
Campaign Credits may be allocated to any eligible active Campaign unless otherwise specified. Members may allocate Campaign Credits:
- In a single transaction
- Across multiple Campaigns
- Through multiple allocations to the same Campaign during the Campaign Period.
Campaign Credit allocations are subject to the Member's available Campaign Credit balance.
8.5 Confirmation of Allocation
Once a Campaign Credit allocation has been successfully processed:
- The allocation becomes effective immediately
- The Member's Campaign Wallet is updated
- The allocation cannot be withdrawn or cancelled except where required by law or expressly authorized by InScape
- The Member receives confirmation through the Platform.
8.6 Insufficient Campaign Credits
- Where a Member attempts to allocate more Campaign Credits than are available in their Campaign Wallet, the requested allocation will not be completed.
- The Platform may provide the Member with one or more of the following options:
- Purchase a Campaign Access Package that includes additional Campaign Credits
- Upgrade to an eligible Membership plan that includes additional recurring Campaign Credits
- Modify the number of Campaign Credits to be allocated
- Return to the Campaign or Campaign Explorer.
Campaign participation will only proceed once the Member has sufficient available Campaign Credits.
8.7 Campaign Availability
Campaigns remain available only during the published Campaign Period. InScape reserves the right to:
- Open Campaigns
- Close Campaigns
- Extend Campaigns
- Shorten Campaigns
- Suspend Campaigns
- Withdraw Campaigns, where reasonably necessary for operational, legal or commercial reasons.
Where practical, Members will be notified of material changes affecting an active Campaign.
8.8 Campaign Closing
Campaigns automatically close at the published closing time using the official InScape Platform timezone (Eastern Time – America/ Florida).
Once a Campaign has closed:
- Further Campaign Credit allocations cannot be made
- Campaign participation is locked
- Campaign data is preserved for audit purposes
- The winner selection process may commence in accordance with the applicable Official Campaign Rules.
8.9 Campaign Modification
Prior to a Campaign closing, InScape may amend:
- Campaign descriptions
- Imagery
- Promotional content
- Eligibility requirements
- Prize details (where reasonably necessary)
- Campaign schedules
- Administrative information,
provided such amendments do not materially disadvantage Members or conflict with applicable laws.
8.10 Campaign Cancellation
InScape reserves the right to cancel, suspend or withdraw any Campaign where reasonably necessary due to:
- Operational issues
- Technical failures
- Fraud or suspected manipulation
- Legal or regulatory requirements
- Prize availability issues
- Force Majeure events
- Circumstances beyond InScape's reasonable control.
Where a Campaign is cancelled before winner selection, InScape may, at its discretion:
- Refund allocated Campaign Credits
- Transfer allocations to a replacement Campaign
- Provide another reasonable remedy permitted by law.
8.11 Fair Participation
Members must not:
- Manipulate Campaign outcomes
- Create multiple Accounts
- Use automated software or bots
- Exploit technical vulnerabilities
- Submit false information
- Interfere with Platform operations
- Engage in any activity that compromises the integrity of a Campaign.
Any breach may result in:
- Cancellation of Campaign participation
- Forfeiture of Campaign Credits
- Suspension or termination of Membership
- Permanent removal from the Platform.
8.12 Campaign Countdown
Campaign countdowns displayed on the Platform are provided as a convenience only. In the event of any discrepancy, the official Campaign closing time recorded by InScape using the Platform's official timezone (Eastern Time – America/ Florida) will prevail.
8.13 No Guarantee of Winning
Participation in a Campaign does not guarantee:
- Selection as a winner
- Receipt of a prize
- Participation in future Campaigns
- Eligibility for future promotions.
Winner selection is conducted strictly in accordance with the applicable Official Campaign Rules.
9. Campaign Winners & Prize Claims
9.1 Winner Selection
At the conclusion of each Campaign, one or more winners will be selected in accordance with the applicable Official Campaign Rules. Winner selection will be conducted using the approved selection method specified for the Campaign and in compliance with all applicable laws and regulations.
The decision of InScape, or its appointed independent representative where applicable, is final.
9.2 Verification of Winners
Before a prize is awarded, InScape may require the selected winner to complete verification procedures, including but not limited to:
- Identity verification
- Age verification
- Residency verification
- Eligibility confirmation
- Acceptance of any required declarations or releases
- Any additional documentation reasonably required for prize fulfilment or legal compliance.
Failure to complete verification within the specified timeframe may result in forfeiture of the prize.
9.3 Prize Claims
Winning Members must claim their prize in accordance with the instructions and timeframes outlined in the applicable Official Campaign Rules. Failure to claim a prize within the specified period may result in the prize being forfeited.
9.4 Prize Delivery
InScape will use reasonable efforts to arrange delivery or fulfilment of prizes within a reasonable timeframe following successful verification. Prize fulfilment may be undertaken by InScape, an authorized supplier or a third-party service provider. Delivery timeframes may vary depending on:
- Prize type
- Supplier availability
- Winner location
- Regulatory requirements
- Circumstances beyond InScape's reasonable control.
9.5 Prize Substitution
Unless otherwise stated in the applicable Official Campaign Rules, prizes are not transferable, exchangeable or redeemable for cash. Where a prize becomes unavailable due to circumstances beyond InScape's reasonable control, InScape reserves the right to substitute the prize with another prize of equal or greater value.
9.6 Taxes and Government Charges
Winners are solely responsible for any taxes, duties, government charges or reporting obligations arising from acceptance or use of a prize unless otherwise expressly stated by InScape.
9.7 Publicity
Subject to applicable privacy laws, a winner may be requested to participate in reasonable promotional activities relating to the Campaign.
Participation in publicity activities may include:
- Photographs
- Interviews
- Video recordings
- Social media content
- Promotional announcements.
Where required by law, InScape will obtain any necessary consent before using a winner's name, image or likeness for promotional purposes.
9.8 Unclaimed Prizes
If a selected winner:
- Cannot be contacted
- Fails to complete verification
- Declines the prize
- Fails to claim the prize within the required timeframe
- Is found to be ineligible,
InScape may, where permitted by the applicable Official Campaign Rules and applicable law:
- Conduct a redraw
- Select an alternate winner
- Deal with the prize in another manner permitted by law.
9.9 Campaign Cancellation
Where a Campaign is cancelled before winner selection due to fraud, technical failure, legal requirements or circumstances beyond InScape's reasonable control, InScape may:
- Cancel the Campaign
- Refund allocated Campaign Credits
- Transfer Campaign Credits to a replacement Campaign
- Provide another reasonable remedy consistent with applicable law.
9.10 Limitation of Liability
To the maximum extent permitted by law, InScape is not responsible for:
- Delays in prize delivery
- Supplier delays
- Manufacturer defects
- Travel disruptions
- Third-party fulfilment failures
- Changes made by prize suppliers
- Circumstances beyond InScape's reasonable control.
Any warranties relating to a prize are provided by the manufacturer or supplier where applicable.
9.11 Official Campaign Rules
Each Campaign is governed by its own Official Campaign Rules. The Official Campaign Rules will specify matters including:
- Eligibility requirements
- Campaign Period
- Prize description
- Prize value
- Winner selection process
- Winner notification
- Prize claim deadlines
- Redraw procedures (if applicable)
- Any Campaign-specific conditions.
Where an inconsistency exists between these Terms and the Official Campaign Rules, the Official Campaign Rules will prevail only in relation to that specific Campaign.
10. Partner Offers Hub
10.1 Partner Offers Hub
The InScape Partner Offers Hub provides eligible Members with access to products, services, experiences and promotional offers made available by approved Partners. The Partner Offers Hub forms part of the Member Benefits available through the Platform and is intended to provide additional value beyond Campaign participation.
Access to the Partner Offers Hub may vary depending on a Member's account type or Membership plan.
10.2 Access to Partner Offers
Unless otherwise stated on the Platform:
- Paid Members may access the Partner Offers Hub as part of their Membership Benefits.
- Free Account holders may have limited or preview access to the Partner Offers Hub but may not be eligible to redeem certain Partner Offers.
- InScape reserves the right to determine which Partner Offers are available to different Membership levels.
10.3 Direct Partners
Some Partner Offers are provided through businesses that have entered into a direct commercial relationship with InScape ("Direct Partners"). Direct Partners are responsible for:
- The accuracy of their offers
- Pricing
- Availability
- Redemption
- Customer service
- Fulfilment
- Compliance with applicable laws.
InScape is not responsible for the performance or fulfilment of Direct Partner offers.
10.4 Affiliate Partners
Some Partner Offers are made available through approved affiliate relationships ("Affiliate Partners"). Where a Member accesses an Affiliate Partner offer:
- The transaction is completed directly with the Affiliate Partner or merchant
- InScape may receive an affiliate commission
- Pricing and availability are determined by the Affiliate Partner
- The Affiliate Partner remains solely responsible for fulfilment and customer support.
10.5 No Endorsement
The inclusion of a Partner, product or service within the Partner Offers Hub does not constitute an endorsement, recommendation or guarantee by InScape. Members should independently assess whether a Partner's products or services meet their individual needs.
10.6 Third-Party Transactions
Any purchase, booking or agreement entered into with a Partner is solely between the Member and that Partner. Except where required by law, InScape is not responsible for:
- Payment disputes
- Product quality
- Shipping
- Delivery
- Cancellations
- Warranties
- Refunds
- Booking amendments
- Customer service
- Any other matter relating to a Partner transaction.
10.7 Partner Offer Availability
Partner Offers may change without notice. Partners may:
- Introduce new offers
- Modify offers
- Withdraw offers
- Suspend promotions
- Discontinue participation in the Platform.
InScape does not guarantee the ongoing availability of any Partner Offer.
10.8 Redemption of Offers
Members are responsible for complying with any terms, conditions or redemption requirements specified by the relevant Partner. Failure to comply with a Partner's redemption requirements may result in the offer being unavailable.
10.9 Partner Content
Information published within the Partner Offers Hub is provided by Partners or their authorized representatives. While InScape makes reasonable efforts to ensure information is current, we do not guarantee the accuracy, completeness or availability of Partner content. Members should verify important information directly with the relevant Partner before completing a purchase or booking.
10.10 Suspension or Removal of Partners
InScape reserves the right to suspend, remove or restrict any Partner or Partner Offer from the Platform at any time where reasonably necessary, including where:
- Legal or regulatory issues arise
- Misleading information is identified
- Customer complaints indicate serious concerns
- Commercial agreements end
- Continued publication is not considered to be in the best interests of Members or the Platform.
10.11 Member Conduct
Members must not misuse Partner Offers, including by:
- Engaging in fraudulent redemptions
- Abusing promotional offers
- Providing false information to Partners
- Attempting to manipulate affiliate tracking systems
- Otherwise breaching these Terms.
Such conduct may result in suspension or termination of Platform access.
10.12 Limitation of Liability
To the maximum extent permitted by law, InScape shall not be liable for any loss, damage or dispute arising from a Member's relationship or transaction with a Partner. Any claim relating to a Partner's products or services should be directed to the relevant Partner.
InScape operates as a promotional and marketing platform connecting Members with participating Partners. Unless expressly stated otherwise, InScape does not manufacture, sell, distribute, own or fulfil the products or services offered by Partners.
11. Referral Program
11.1 Referral Program
InScape may offer a Referral Program that enables eligible Members to invite new users to join the Platform. The Referral Program is intended to reward genuine referrals that contribute to the growth of the InScape community. Participation in the Referral Program is voluntary and subject to these Terms.
11.2 Referral Links
Eligible Members may receive a unique referral link, referral code or other referral mechanism generated by the Platform.
Referral links are personal to the Member and must not be:
- Sold
- Transferred
- Published in a misleading manner
- Used for spam or unsolicited communications
- Promoted in any way that breaches applicable laws or these Terms.
11.3 Qualified Referrals
A referral reward will only be issued where a referral satisfies the qualification criteria determined by InScape. Qualification requirements may include, but are not limited to:
- Creation of a valid InScape Account
- Verification of the new Member
- Successful Membership purchase
- Completion of a qualifying action
- Any additional requirements published on the Platform.
Referral rewards are not earned until all qualification requirements have been satisfied.
11.4 Referral Rewards
Where a referral qualifies, InScape may award referral incentives including:
- Campaign Credits
- Promotional Campaign Credits
- Member Benefits
- Promotional rewards
- Other incentives determined by InScape.
The type and value of referral rewards are published on the Platform and may change from time to time.
11.5 Referral Approval
Referral rewards are issued only after InScape has verified that all qualification requirements have been satisfied. Referral rewards may remain pending while verification is completed.
11.6 Referral Restrictions
Referral rewards will not be issued where InScape reasonably determines that a referral involves:
- Duplicate Accounts
- Self-referrals
- Fraudulent registrations
- Fake identities
- Payment fraud
- Cancelled qualifying transactions
- Abuse of promotional offers
- Any breach of these Terms.
11.7 Referral Reversals
InScape reserves the right to reverse previously awarded referral rewards where:
- The referred Member is later found to be ineligible
- The qualifying transaction is cancelled or refunded
- Fraud or abuse is identified
- Referral rewards were issued in error.
Any reversal will be recorded within the Member's Campaign Wallet where applicable.
11.8 Referral Program Changes
InScape may:
- Modify referral qualification requirements
- Change referral reward values
- Introduce promotional referral campaigns
- Suspend the Referral Program
- Discontinue the Referral Program,
at any time without prior notice, unless otherwise required by applicable law. Changes will not affect referral rewards that have already been validly earned and approved.
11.9 Promotional Referrals
From time to time, InScape may operate promotional referral campaigns offering enhanced referral rewards. Such promotions are governed by any additional terms published for that promotion.
11.10 Fraud Prevention
InScape actively monitors referral activity. Where unusual referral behavior is identified, InScape may:
- Delay reward issuance
- Request identity verification
- Investigate referral activity
- Suspend Accounts
- Cancel referral rewards
- Permanently remove Members from the Referral Program.
11.11 No Guarantee
Participation in the Referral Program does not guarantee that referral rewards will be earned. Referral rewards are issued only after all applicable qualification criteria have been satisfied and verified by InScape.
12. Payments, Billing & Renewals
12.1 Payments
Members may purchase Memberships, Campaign Access Packages and other eligible Platform products or services using the payment methods made available through the Platform. All payments are processed securely through authorized third-party payment providers. InScape does not store complete payment card details unless expressly stated in our Privacy Policy or permitted by applicable law.
12.2 Pricing
All prices displayed on the Platform are shown in the applicable currency and include or exclude taxes where required by applicable law. InScape reserves the right to change pricing for Memberships, Campaign Access Packages and other products or services at any time. Price changes will not affect completed purchases.
12.3 Payment Authorization
By completing a purchase, you:
- Confirm you are authorized to use the nominated payment method
- Authorize InScape to charge the applicable amount
- Acknowledge that payment is subject to approval by your financial institution or payment provider.
12.4 Recurring Membership Payments
Memberships operate on a recurring subscription basis. Unless cancelled in accordance with these Terms, your Membership will automatically renew at the end of each billing cycle. You authorize InScape to automatically process future Membership payments using your nominated payment method until your Membership is cancelled.
12.5 Failed Membership Payments
Where a Membership renewal payment fails:
- The Membership will enter a Grace (Past Due) status
- Reasonable payment retry attempts may be made
- The Member may be asked to update their payment method
- Member-only benefits may be suspended until payment has been successfully received.
No monthly Campaign Credits will be issued while the Membership remains in a Past Due status.
12.6 Cancellation Following Failed Payments
If InScape is unable to successfully process payment after three (3) consecutive renewal attempts, the Membership may be cancelled automatically. Upon cancellation:
- Recurring Campaign Credit allocations cease
- Access to Member-only benefits ceases
- Partner Offers Hub access may be removed
- Premium Platform features may become unavailable.
Members may reactivate their Membership at any time by successfully completing a new subscription purchase.
12.7 Payment Disputes & Chargebacks
If a payment is disputed, reversed or subject to a chargeback, InScape reserves the right to:
- Suspend the Member's Account
- Reverse associated Campaign Credits
- Suspend Campaign participation
- Suspend Membership Benefits
- Recover any improperly issued benefits where permitted by law.
Nothing in this clause limits any rights available to Members under applicable consumer protection legislation.
12.8 Taxes
Members are responsible for any taxes, duties, levies or government charges associated with purchases made through the Platform unless otherwise stated.
12.9 Billing Records
Electronic payment records maintained by InScape and its authorized payment providers constitute evidence of purchases made through the Platform. Members are responsible for reviewing billing confirmations and notifying InScape of any suspected billing error within a reasonable period.
12.10 Payment Providers
Payments are processed through independent third-party payment providers. Use of those payment services may also be subject to the provider's own terms and privacy policies. InScape is not responsible for service interruptions, delays or failures caused by third-party payment providers.
12.11 Promotional Pricing
From time to time, InScape may offer promotional pricing, introductory Membership offers, discount codes or other pricing incentives. Unless otherwise stated:
- Promotional offers cannot be combined
- Promotional pricing is available only during the advertised promotional period
- Promotional pricing does not guarantee future pricing.
12.12 Billing Time Standard
All Membership renewals, recurring billing events, Campaign Credit allocations and other payment-related events are processed using the official InScape Platform timezone of Eastern Time (America/ Florida).
13. Refunds & Cancellations
13.1 Membership Cancellation
Members may cancel their Membership at any time through their InScape Account. Unless otherwise required by applicable law:
- Cancellation will take effect at the end of the current billing period.
- Membership fees already paid are non-refundable.
- Members will continue to receive Membership Benefits until the end of the current billing period.
- No further recurring Membership payments will be processed after cancellation becomes effective.
13.2 Campaign Access Packages
Campaign Access Packages are one-time purchases. Once payment has been successfully processed and the associated Campaign Credits have been issued to the Member's Campaign Wallet, the purchase is generally non-refundable except where required by applicable law or expressly approved by InScape.
13.3 Campaign Credit Refunds
Campaign Credits themselves are not refundable, redeemable for cash or exchangeable. Where InScape approves a refund for a Campaign Access Package or Membership, InScape may remove any associated Campaign Credits that have not already been allocated to a Campaign. Campaign Credits that have already been allocated to an active or closed Campaign generally cannot be refunded or reinstated.
13.4 Duplicate Payments
If a Member is charged more than once for the same purchase due to a verified processing error, InScape will investigate the matter and, where appropriate, issue a refund for the duplicate payment.
13.5 Payment Errors
If a payment has been processed incorrectly due to a Platform error, administrative error or payment processing issue, InScape may, at its discretion:
- Issue a full or partial refund
- Issue replacement Campaign Credits
- Reverse an incorrect transaction
- Provide another reasonable remedy.
13.6 Consumer Rights
Nothing in these Terms limits or excludes any rights that cannot legally be excluded under applicable consumer protection legislation. Where applicable law requires a refund, replacement or other remedy, InScape will comply with those legal obligations.
13.7 Fraudulent Refund Requests
InScape reserves the right to refuse any refund request that is fraudulent, misleading or inconsistent with these Terms. Where fraudulent refund activity is identified, InScape may suspend or terminate the Member's Account and pursue any remedies available under applicable law.
13.8 Refund Processing
Approved refunds will generally be returned to the original payment method used for the purchase. Refund processing times may vary depending on the payment provider or financial institution. InScape is not responsible for delays caused by third-party payment providers or banking institutions.
13.9 Promotional Purchases
Memberships or Campaign Access Packages purchased as part of a promotional offer, discount campaign or limited-time promotion remain subject to these Terms unless additional promotional terms expressly state otherwise.
13.10 Cancellation by InScape
InScape reserves the right to suspend or cancel a Membership or Campaign Access purchase where reasonably necessary due to:
- Fraud
- Payment reversal or chargeback
- Breach of these Terms
- Unlawful activity
- Technical error
- Legal or regulatory requirements.
Where appropriate, InScape may provide a refund, replacement benefit or other remedy consistent with applicable law.
13.11 Discretionary Goodwill Refunds
Nothing in these Terms prevents InScape from providing refunds, account credits, promotional Campaign Credits or other goodwill remedies at its sole discretion. Any such remedy is provided as a gesture of goodwill and does not create an ongoing entitlement or establish a precedent for future claims.
14. Platform Integrity, Fair Use & User Conduct
14.1 Responsible Use
Members must use the Platform lawfully, honestly and in accordance with these Terms. The Platform is intended solely for its intended purpose of providing Campaign participation, Membership services and access to Partner Offers. Members must not engage in any conduct that compromises the integrity, security or operation of the Platform.
14.2 Prohibited Conduct
Members must not:
- Create multiple Accounts without authorization
- Impersonate another person or entity
- Provide false or misleading information
- Interfere with the operation of the Platform
- Attempt to gain unauthorized access to any system or Account
- Exploit bugs, vulnerabilities or technical errors
- Use bots, scripts, automation tools or artificial methods to interact with the Platform
- Manipulate Campaigns or Campaign Credit allocations
- Abuse Membership Benefits or Partner Offers
- Engage in fraudulent payment activity
- Use the Platform for unlawful purposes
- Encourage or assist another person to engage in prohibited conduct.
14.3 Platform Integrity
Members must not attempt to:
- Manipulate Campaign outcomes
- Artificially generate Campaign Credits
- Interfere with Campaign selection processes
- Disrupt Platform operations
- Overload Platform infrastructure
- Reverse engineer Platform functionality
- Circumvent Platform security measures.
14.4 Fraud Prevention
InScape actively monitors the Platform for fraudulent, deceptive or suspicious activity. Where InScape reasonably believes fraudulent conduct has occurred, it may:
- Suspend an Account
- Remove Campaign Credits
- Cancel Campaign participation
- Terminate a Membership
- Refuse prize claims
- Cancel referral rewards
- Permanently restrict access to the Platform.
14.5 Fair Use
Members must use Membership Benefits, Campaign Access Packages, Campaign Credits and Partner Offers in a fair and reasonable manner. InScape may investigate activity that appears excessive, abnormal or inconsistent with ordinary Member behavior.
14.6 Account Sharing
Accounts are personal to the registered Member. Members must not:
- Share login credentials
- Permit another person to use their Account
- Purchase Memberships on behalf of another person for the purpose of sharing benefits
- Transfer access to another individual.
14.7 Security
Members must not knowingly introduce:
- Malware
- Viruses
- Ransomware
- Malicious code
- Denial-of-service attacks
- Any software intended to disrupt or compromise the Platform.
14.8 Intellectual Property Misuse
Members must not copy, reproduce, distribute or commercially exploit any part of the Platform except as expressly permitted by InScape.
14.9 Investigations
InScape reserves the right to investigate any suspected breach of these Terms. Members agree to reasonably cooperate with any investigation relating to:
- Fraud
- Security incidents
- Payment disputes
- Prize verification
- Abuse of Platform features
- Unlawful activity.
14.10 Enforcement
Where InScape reasonably determines that a Member has breached these Terms, it may take one or more of the following actions:
- Issue a warning
- Suspend Platform access
- Suspend Membership Benefits
- Remove Campaign Credits
- Reverse referral rewards
- Cancel Campaign participation
- Terminate the Account
- Take legal action where appropriate.
Nothing in this section limits any other rights or remedies available to InScape under these Terms or applicable law.
14.11 Reporting Misuse
Members who become aware of suspected fraud, security vulnerabilities or misuse of the Platform are encouraged to notify InScape promptly through the official support channels.
14.12 No Waiver
Failure by InScape to enforce any provision of these Terms does not constitute a waiver of its right to enforce that provision or any other provision at a later time.
15. Intellectual Property
15.1 Ownership
The InScape Platform, including its software, website, mobile applications, user interfaces, branding, logos, graphics, designs, content, text, images, videos, databases, business processes, workflows and all associated intellectual property rights are owned by or licensed to InScape and are protected by applicable intellectual property laws.
Nothing in these Terms transfers ownership of any intellectual property rights to a Member.
15.2 Limited Licence
Subject to these Terms, InScape grants Members a limited, non-exclusive, non-transferable and revocable licence to access and use the Platform solely for its intended personal and non-commercial purposes. This licence automatically terminates if a Member's Account is suspended or terminated.
15.3 Restrictions
Except where expressly permitted by law or with InScape's prior written consent, Members must not:
- Copy or reproduce any part of the Platform
- Modify or create derivative works
- Distribute Platform content
- Sell, license or commercially exploit any Platform content
- Reverse engineer, decompile or disassemble any software
- Remove copyright, trademark or proprietary notices
- Use Platform content to develop competing products or services
- Scrape, harvest or extract Platform data using automated means.
15.4 Trademarks
"InScape", the InScape logo and all associated names, logos, graphics, slogans and branding are trademarks or registered trademarks owned by or licensed to InScape. Nothing in these Terms grants any right to use InScape's trademarks without prior written permission.
15.5 Third-Party Intellectual Property
The Platform may display trademarks, logos, product names, images and other intellectual property belonging to Partners, Affiliate Partners or other third parties. All such intellectual property remains the property of its respective owner. Nothing in these Terms grants Members any rights in relation to third-party intellectual property.
15.6 User Content
Where Members submit reviews, feedback, testimonials, suggestions, photographs or other content ("User Content") to the Platform, the Member confirms that:
- They own or have permission to submit the content
- The content does not infringe the rights of any third party
- The content is not unlawful, defamatory or misleading.
By submitting User Content, the Member grants InScape a worldwide, royalty-free, perpetual, irrevocable, transferable and sublicensable license to use, reproduce, publish, modify, distribute and display that content for the purposes of operating, promoting and improving the Platform.
15.7 Feedback
Any ideas, suggestions, recommendations or feedback provided by Members regarding the Platform may be used by InScape without restriction or obligation to compensate the Member.
15.8 Copyright Infringement
If a person believes material published on the Platform infringes their intellectual property rights, they should notify InScape in writing with sufficient information to allow the claim to be investigated.
InScape reserves the right to remove or disable access to allegedly infringing material while an investigation is undertaken.
15.9 Reservation of Rights
All rights not expressly granted under these Terms are reserved by InScape. No implied licenses or rights are granted to Members.
15.10 Survival
The provisions of this section survive termination or cancellation of a Member's Account and continue to apply after these Terms have otherwise ended.
15.11 Artificial Intelligence & Data Use
Members must not use automated tools, artificial intelligence systems, machine learning models, bots or other technologies to copy, scrape, harvest, reproduce, train, analyze or otherwise exploit any content, data or functionality of the Platform without InScape's prior written consent.
16. Privacy, Communications & Third-Party Services
16.1 Privacy
Your privacy is important to InScape.
Our collection, use, disclosure and storage of personal information is governed by our Privacy Policy, which forms part of these Terms. By using the Platform, you acknowledge that you have read and accepted the Privacy Policy.
16.2 Electronic Communications
By creating an Account, you consent to receiving electronic communications from InScape, including:
- Account notifications
- Membership notifications
- Campaign updates
- Payment confirmations
- Security notifications
- Winner notifications
- Service announcements
- Other communications necessary for operating your Account.
Marketing communications may be managed through your communication preferences where applicable.
16.3 Platform Notifications
InScape may communicate with Members using:
- Push notifications
- SMS (where applicable)
- In-app notifications
- Other electronic communication channels.
Members are responsible for maintaining accurate contact details.
16.4 Third-Party Services
The Platform may integrate with third-party services including payment providers, affiliate networks, analytics providers, identity verification services and Partners. Those services operate under their own terms and privacy policies.
InScape is not responsible for third-party systems or services beyond its reasonable control.
16.5 Links to Third-Party Websites
The Platform may contain links to external websites operated by third parties. InScape does not control, endorse or accept responsibility for external websites or their content.
Members access third-party websites at their own risk.
17. Disclaimers, Limitation of Liability & Indemnification
17.1 Platform Availability
The Platform is provided on an "as available" and "as is" basis.
While InScape uses reasonable efforts to maintain reliable services, we do not guarantee uninterrupted, secure or error-free operation.
17.2 No Warranty
To the maximum extent permitted by law, InScape disclaims all warranties, whether express or implied, including warranties relating to:
- Merchantability
- Fitness for a particular purpose
- Uninterrupted availability
- Accuracy of information
- Non-infringement.
17.3 Limitation of Liability
To the fullest extent permitted by law, InScape shall not be liable for any indirect, incidental, consequential, special, exemplary or punitive damages arising out of or relating to:
- Use of the Platform
- Campaign participation
- Memberships
- Campaign Access Packages
- Partner Offers
- Third-party products or services
- Delays
- Technical failures
- Circumstances beyond our reasonable control.
Nothing in these Terms excludes liability that cannot legally be excluded.
17.4 Maximum Liability
Where liability cannot legally be excluded, InScape's maximum liability shall be limited to the amount paid by the Member to InScape during the twelve (12) months immediately preceding the event giving rise to the claim, or such greater amount as required by applicable law.
17.5 Indemnity
You agree to indemnify and hold harmless InScape, its directors, officers, employees, contractors, affiliates and Partners from any claims, damages, liabilities, losses or expenses arising from:
- Your breach of these Terms
- Your misuse of the Platform
- Your unlawful conduct
- Your infringement of the rights of another person.
18. Dispute Resolution & Governing Law
18.1 Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Florida, United States, without regard to conflict of law principles.
InScape intends to operate its Platform and Campaigns in accordance with applicable laws in the jurisdictions in which it conducts business.
Campaign participation is subject to these Terms, the Official Campaign Rules and any applicable legal requirements.
Where required by applicable law, InScape may modify Campaign procedures, eligibility requirements or participation methods to maintain legal compliance.
18.2 Jurisdiction
Subject to any mandatory rights under applicable law, the parties submit to the exclusive jurisdiction of the state and federal courts located in the State of Florida for the resolution of any dispute arising out of or relating to these Terms or the Platform.
18.3 Good Faith Resolution
Before commencing legal proceedings, both parties agree to make reasonable efforts to resolve any dispute through good faith discussions. Nothing in this clause prevents either party from seeking urgent injunctive or equitable relief where necessary.
19. General Provisions
19.1 Entire Agreement
These Terms, together with the Privacy Policy, Official Campaign Rules and any other documents expressly incorporated by reference, constitute the entire agreement between InScape and the Member.
19.2 Severability
If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue in full force and effect.
19.3 No Waiver
Failure by InScape to enforce any provision of these Terms does not constitute a waiver of that provision or any other right.
19.4 Assignment
Members may not assign or transfer their rights or obligations under these Terms without InScape's prior written consent.
InScape may assign or transfer its rights and obligations in connection with a merger, acquisition, corporate restructure or sale of assets.
19.5 Force Majeure
InScape shall not be liable for delays or failure to perform its obligations where such failure results from events beyond its reasonable control, including natural disasters, acts of government, war, terrorism, cyberattacks, labour disputes, utility failures or interruptions to third-party services.
19.6 Survival
Any provisions that by their nature are intended to survive termination of these Terms, including those relating to intellectual property, limitation of liability, indemnity, dispute resolution and governing law, shall survive termination.
19.7 Contact Information
Questions regarding these Terms may be directed to InScape using the contact details published on the Platform.
19.8 Effective Date
These Terms become effective on the date published by InScape and remain in force until replaced by a subsequent version.
20. Official Campaign Rules
20.1 Application
These Official Campaign Rules apply to every Campaign conducted through the InScape Platform unless expressly varied by the applicable Campaign Schedule.
Participation in any Campaign constitutes acceptance of:
- These Terms & Conditions
- These Official Campaign Rules
- The applicable Campaign Schedule.
20.2 Campaign Schedule
Each Campaign will publish a Campaign Schedule containing information including:
- Campaign title
- Campaign identifier
- Prize description
- Prize value
- Campaign opening date
- Campaign closing date
- Winner selection date
- Prize claim period
- Prize inclusions
- Any Campaign-specific eligibility requirements
- Any additional Campaign conditions.
Where a Campaign Schedule conflicts with these Official Campaign Rules, the Campaign Schedule prevails only for that Campaign.
20.3 Campaign Period
Campaign participation is only permitted during the published Campaign Period. Campaign opening and closing times are determined using the official InScape Platform timezone:
Eastern Time (America/ Florida).
No Campaign Credit allocations will be accepted after the published closing time.
20.4 Eligibility
Unless otherwise stated within the Campaign Schedule, participants must:
- Hold a valid InScape Account
- Satisfy all eligibility requirements
- Comply with these Terms
- Comply with these Official Campaign Rules
- Satisfy any additional eligibility requirements published for the Campaign.
20.5 Campaign Credits
Campaign participation occurs by allocating Campaign Credits.
Campaign Credits allocated to a Campaign:
- Are deducted immediately from the Campaign Wallet
- Become irrevocable once confirmed
- Cannot be transferred to another Campaign after the Campaign closes unless expressly authorized by InScape.
20.6 Winner Selection
At the conclusion of each Campaign, one (1) or more provisional winners will be selected in accordance with the applicable Campaign Schedule and these Official Campaign Rules.
- Winner selection will only occur after:
- The Campaign has officially closed
- All Campaign Credit allocations have been finalized and recorded
- Any required eligibility and compliance checks have been completed
- Any required audit or integrity verification procedures have been undertaken.
Unless otherwise specified in the applicable Campaign Schedule, winner selection will be conducted using an independent electronic random selection process designed to produce a fair, unbiased and verifiably random outcome from all eligible Campaign Credit allocations received during the Campaign Period.
InScape will not manually select or influence the outcome of any winner selection process.
To promote transparency and Member confidence, InScape may conduct or broadcast the winner selection process live through the Platform, its official website, official social media channels or other official communication channels. Any live broadcast is provided for transparency only and does not affect the validity of the winner selection process.
InScape reserves the right to appoint an independent third party, auditor or authorized representative to oversee, witness or verify the winner selection process where considered appropriate.
The electronic records maintained by InScape relating to the Campaign, Campaign Credit allocations and winner selection process shall constitute prima facie evidence of the outcome, unless proven otherwise.
20.7 Winner Notification
Following completion of the winner selection process, InScape will make reasonable efforts to notify the provisional winner using the contact information associated with the Member's InScape Account.
Notification may be provided through one or more of the following methods:
- Notification within the Member Dashboard
- Telephone
- SMS (where applicable)
- Mobile application push notification (where applicable)
- Any other communication method reasonably considered appropriate by InScape.
The Member is solely responsible for ensuring that their contact details remain accurate, complete and up to date at all times.
Notification of selection does not automatically entitle a Member to receive a prize. All prizes remain subject to successful completion of the eligibility verification and prize claim process in accordance with these Terms, the Official Campaign Rules and the applicable Campaign Schedule.
Where a provisional winner cannot be contacted, fails to respond within the prescribed timeframe, fails to satisfy the eligibility requirements or otherwise becomes ineligible, InScape may declare the selection invalid and proceed in accordance with Clause 20.11 (Unclaimed Prizes).
Following successful verification and acceptance of the prize, InScape may publish the winner's first name, surname initial, city, state or other information required or permitted by applicable law on the Platform and through InScape's official communication channels. By participating in a Campaign, Members acknowledge that winner information may be published where required for transparency, promotional purposes or legal compliance, subject to applicable privacy laws.
20.8 Prize Verification
Prior to receiving a prize, a selected winner may be required to provide:
- Government-issued identification
- Proof of address
- Age verification
- Eligibility confirmation
- Any additional documentation reasonably required.
Failure to provide requested information within the required timeframe may result in forfeiture.
20.9 Prize Acceptance
Prizes are accepted subject to:
- Applicable laws
- Supplier requirements
- Any conditions specified within the Campaign Schedule.
Unless otherwise stated:
- Prizes cannot be exchanged
- Prizes cannot be transferred
- Prizes cannot be redeemed for cash.
Where a cash alternative is advertised within the Campaign Schedule, the winner may elect that option.
20.10 Prize Fulfilment
Prize fulfilment will occur within a reasonable period following successful verification.
Some prizes may be fulfilled directly by:
- Manufacturers
- Dealerships
- Travel providers
- Event organizers
- Other authorized suppliers.
20.11 Unclaimed Prizes
If a winner:
- Cannot be contacted
- Declines the prize
- Fails verification
- Fails to respond
- Fails to satisfy eligibility requirements
InScape may:
- Redraw the prize
- Select an alternate winner
- Deal with the prize as permitted by law.
20.12 Campaign Cancellation
InScape reserves the right to suspend, amend or cancel any Campaign where reasonably necessary due to:
- Fraud
- Technical failures
- Legal requirements
- Supplier issues
- Force Majeure events
- Circumstances beyond reasonable control.
Where a Campaign is cancelled before winner selection, InScape may refund allocated Campaign Credits or provide another reasonable remedy.
20.13 Errors
InScape reserves the right to correct:
- Typographical errors
- Pricing errors
- Prize description errors
- Administrative errors
- Technical errors
provided no Member is materially disadvantaged in a manner inconsistent with applicable law.
20.14 Decisions
Subject to applicable law, all decisions made by InScape regarding the administration of Campaigns, eligibility, winner verification and prize fulfilment are final.
20.15 Campaign Records
InScape may maintain electronic records relating to:
- Campaign participation
- Campaign Credit allocations
- Winner selection
- Verification
- Prize fulfilment
- Audit information.
These records may be relied upon in resolving disputes relating to a Campaign.
